Reprieve has represented a number of these people.<\/p>\n\n\n\n<p>For example, Binyam Mohamed. UK intelligence officers actively traded intelligence about him, even though they knew he was being tortured. And the <a href=\"https:\/\/hansard.parliament.uk\/commons\/2018-05-10\/debates\/B9AD50CD-9D54-41DA-A18B-1526E7658593\/BelhajAndBoudcharLitigationUpdate\" target=\"_blank\" rel=\"noreferrer noopener\">Libyan dissident Abdelhakim Belhaj received an apology from the Prime Minister in 2018<\/a> for the UK\u2019s role in his kidnap and rendition to Colonel Ghaddafi\u2019s torture chambers.<\/p>\n\n\n\n<p>In July 2019, the UK Government published a new policy on intelligence sharing titled \u201c<em>The Principles Relating to Detention and Interviewing of Detainees Overseas and the Passing and Receipt of Intelligence Relating to Detainees<\/em>\u201d. Effectively this is the UK\u2019s \u201c<a href=\"https:\/\/assets.publishing.service.gov.uk\/government\/uploads\/system\/uploads\/attachment_data\/file\/818306\/20190718_The_Principles_relating_to_the_detention_and_interviewing_of_detainees_overseas.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">torture policy<\/a>\u201d.<\/p>\n\n\n\n<p>This policy is designed to make sure the UK does not pass intelligence abroad, which could lead to someone being tortured; or to use information which may have been obtained under torture.&nbsp;<\/p>\n\n\n\n<p>MPs from all parties have said that this new \u201ctorture policy\u201d should explicitly prohibit UK intelligence sharing where there is a \u201cserious risk\u201d of torture or CIDT. But this policy is still unclear. It simply suggests that Ministers should \u201clook at the full complexities of the case and its legality\u201d.<\/p>\n\n\n\n<p>Unfortunately, uncertainty around this policy has led to significant confusion among Ministers and officials about what kind of intelligence sharing they are legally able to approve.<\/p>\n\n\n\n<p>In April 2019, Reprieve and the Rendition Project revealed that the Ministry of Defence (MoD) had maintained a secret policy which suggested that Ministers could approve action carrying a serious risk of torture if \u201cthe potential benefits justify accepting the risk and legal consequences.\u201d<\/p>\n\n\n\n<p>The MoD\u2019s secret policy was exposed on the <a rel=\"noreferrer noopener\" href=\"https:\/\/www.thetimes.co.uk\/edition\/news\/torture-britain-breaks-law-in-ministry-of-defence-secret-policy-2rl5dn2kd\" target=\"_blank\">front page of The Times<\/a> newspaper. MPs &#8211; including the former Brexit Secretary David Davis &#8211; then called on the Government to change the policy. They succeeded, and this secret MoD was subsequently replaced. But the Government\u2019s wider torture policy remains ambiguous.&nbsp;<\/p>\n\n\n\n<p>Parliament\u2019s Intelligence and Security Committee (ISC) has raised concerns that \u201c<a href=\"https:\/\/b1cba9b3-a-5e6631fd-s-sites.googlegroups.com\/a\/independent.gov.uk\/isc\/files\/20180628_HC1114_Report_Detainee_Mistreatment_and_Rendition-Current_Issues.pdf?attachauth=ANoY7cpMu-KI3iQANZKFIbPR8r07-w3kxpijlACMVdABDwXIA2kHjGY-q9-nRSMsZEvvvapB3oPabKdFLu5aAEszWUcyE6qgRHdPZTTBz5NLPcb2qajKZyRUnFiu5tZvuGAtXoA2V4_CXOuIX4Na7bdJj4H4oeR91wjW7UBjLLpIFaQFdVIp2B2O_0Fxnool4fXBZvN1zKtqam2seQBcLpyJIfMO2zLxBBmprlBwglBWx-eb6OuY4i5XSyJgWIH1M-Xlm3mgQHJgu5Ebq8Ttv5md3y5PwFCBkoZhZZ7lJ8IxgU4GjtvNTvE%3D&amp;attredirects=1\" target=\"_blank\" rel=\"noreferrer noopener\">dangerous ambiguities<\/a>\u201d in the UK\u2019s torture policy amount to a \u201cstructural weakness\u201d that leaves individual Ministers with \u201centirely different understandings of what they can and cannot, and would and would not, authorise\u201d.<\/p>\n\n\n\n<p>The ISC carried out an inquiry into the policy. As part of this, it asked a number of Secretaries of State whether they were allowed to authorise action where there was a serious risk of torture. Strikingly, <a href=\"https:\/\/b1cba9b3-a-5e6631fd-s-sites.googlegroups.com\/a\/independent.gov.uk\/isc\/files\/20180628_HC1114_Report_Detainee_Mistreatment_and_Rendition-Current_Issues.pdf?attachauth=ANoY7coHloiNUfXfgwg8BDGjlss1v50wiDSfsrbu9bms7vz77EpbqPSN5ycaiNBpWTlNEXygeT5OJd6HVt0a9Ejs-r5BxBpUiAJk3QIHZVtwMaliBC3nWdmBCLi_Hqq0wvicxx20p0QoIttDdma5V1PzgYcloV_I3Lf7jT1-YSZ6Nb6ac4CpkGuG6Dd4D-QzsHpZPFPMBoqd5S4J4HXo6SW4KioHW03C_7kjFlv1DoT73UnHl5sNyKuTx_LGilFJ_xGsDWJwE7uk3RqzvGvlGcLQP5RTMuiw9IMH6ArZ7q6B-qzFcM1oFK0%3D&amp;attredirects=1\" target=\"_blank\" rel=\"noreferrer noopener\">each gave significantly different answers<\/a>.<\/p>\n\n\n\n<p>If the Government is to stand by <a href=\"https:\/\/www.gov.uk\/government\/news\/uk-government-reaffirms-its-commitment-to-combat-torture\" target=\"_blank\" rel=\"noreferrer noopener\">its position<\/a> that \u201cthe UK government condemns torture in all circumstances\u201d, it cannot reserve the right to authorise UK action when there is a risk that torture may take place.<\/p>\n\n\n\n<p>Torture doesn&#8217;t work. It is more likely to harm an urgent investigation than it is to improve it.&nbsp; For example, the US Senate Select Committee on Intelligence\u2019s <a href=\"https:\/\/www.intelligence.senate.gov\/sites\/default\/files\/publications\/CRPT-113srpt288.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">report on the CIA\u2019s detention and rendition programme<\/a> could identify no documented instances in which the use of mistreatment generated actionable intelligence. Reserving the right to become involved in torture &#8211; as the UK&#8217;s current policy does &#8211; completely ignores this. Reprieve is calling for a change to the UK\u2019s torture policy. It should clearly and unequivocally prohibit any UK action where there is a \u201cserious risk\u201d of torture and CIDT.
