{"id":13629,"date":"2019-04-11T15:36:38","date_gmt":"2019-04-11T15:36:38","guid":{"rendered":"https:\/\/reprieve.org.uk\/?post_type=press&#038;p=13629"},"modified":"2021-03-23T12:25:16","modified_gmt":"2021-03-23T12:25:16","slug":"uk-government-signals-it-could-back-britons-in-syria-facing-death-penalty-in-iraq","status":"publish","type":"post","link":"https:\/\/reprieve.org\/uk\/2019\/04\/11\/uk-government-signals-it-could-back-britons-in-syria-facing-death-penalty-in-iraq\/","title":{"rendered":"UK Government signals it could back Britons in Syria facing death penalty in Iraq"},"content":{"rendered":"<p>The UK Government has given the <a href=\"https:\/\/www.parliament.uk\/business\/publications\/written-questions-answers-statements\/written-question\/Lords\/2019-03-25\/HL14765\/\">clearest indication yet<\/a> of its <a href=\"https:\/\/www.parliament.uk\/business\/publications\/written-questions-answers-statements\/written-question\/Lords\/2019-03-25\/HL14767\/\">preferred destination<\/a> for British nationals detained in North East Syria, explicitly opposing their transfer to the <a href=\"https:\/\/www.parliament.uk\/business\/publications\/written-questions-answers-statements\/written-question\/Commons\/2019-03-25\/236249\/\">Assad regime<\/a> or the US facility at <a href=\"https:\/\/www.parliament.uk\/business\/publications\/written-questions-answers-statements\/written-question\/Commons\/2019-03-25\/236248\/\">Guantanamo Bay<\/a>, but confirming it is in \u201cregular discussions\u201d with the Government of Iraq about how to \u201cachieve justice\u201d.<\/p>\n<p>It was reported yesterday that Iraq has offered to try such prisoners for a price of \u00a32 million per head \u2013 a figure pegged to the annual cost of imprisoning and individual at Guantanamo Bay.<\/p>\n<p>If British detainees were handed over to Iraq they would likely face the death penalty with no prospect of a fair trial.&nbsp;<a href=\"https:\/\/www.hrw.org\/news\/2018\/10\/31\/us-detainees-transferred-syria-iraq\">Human Rights Watch<\/a>&nbsp;has reported that trials of suspected IS members \u201care summary and often do not put forward evidence of specific offences\u201d, while \u201cinterrogators routinely use torture to extract confessions, and in most cases judges ignore torture allegations from defendants\u201d.<\/p>\n<p>The UK Government itself has&nbsp;<a href=\"https:\/\/assets.publishing.service.gov.uk\/government\/uploads\/system\/uploads\/attachment_data\/file\/725552\/FCO1124_Human_Rights_Report_2017_ONLINE.PDF\">previously&nbsp;acknowledged<\/a>&nbsp;the widespread use of torture and the death penalty across the Iraqi criminal justice system.<\/p>\n<p><strong>Reprieve\u2019s Director Maya Foa said:<\/strong> \u201cBy outsourcing justice to the Iraqi courts, the UK Government would create a real risk of British citizens&nbsp;being sentenced to death in ten minute trials. Accountability and justice for the crimes committed will only come through fair trials and effective prosecutions, not through torture and summary executions.
