{"id":13471,"date":"2019-02-15T10:57:04","date_gmt":"2019-02-15T10:57:04","guid":{"rendered":"https:\/\/reprieve.org.uk\/?post_type=update&#038;p=13471"},"modified":"2020-11-13T15:07:15","modified_gmt":"2020-11-13T15:07:15","slug":"17-years-of-guantanamo-bay","status":"publish","type":"post","link":"https:\/\/reprieve.org\/uk\/2019\/02\/15\/17-years-of-guantanamo-bay\/","title":{"rendered":"5 reasons to oppose Trump&#8217;s &#8216;Temple of Torture&#8217;"},"content":{"rendered":"<h2>17 years since it opened, Guant\u00e1namo remains as significant and problematic as ever.<\/h2>\n<ul>\n<li>The notion that the men in Guant\u00e1namo Bay are \u2018the worst of the worst\u2019 is a myth<\/li>\n<li>Despite evidence that torture isn\u2019t effective as a means of interrogation, Donald Trump supports its use<\/li>\n<li>Trump insists that no more detainees can leave the prison \u2013 not even the five men cleared for release<\/li>\n<\/ul>\n<p>Here are 5 of the most compelling reasons why Guant\u00e1namo Bay should be closed for good.<\/p>\n<h2><\/h2>\n<h2>1. The \u2018worst of the worst\u2019 myth<\/h2>\n<p>More detainees have died in Guant\u00e1namo than have been convicted of a crime. The U.S.\u2019 claim that Guant\u00e1namo detainees were the \u2018worst of the worst\u2019 did not stand up &#8211; U.S. authorities started to release those who had been abducted and imprisoned as early as 2002, the year the prison opened. Now, only 40 remain from a total of 780.<\/p>\n<p>In fact, within a year of opening, Guant\u00e1namo\u2019s operational commander complained that he was being sent too many \u201cMickey Mouse\u201d detainees. As the Inter-American Commission on Human Rights points out: \u201cAccording to official information, only 8% of Guant\u00e1namo detainees were characterised as \u2018fighters\u2019 for Al-Qaeda or the Taliban; 93% were not captured by U.S. forces; and most were turned over to U.S. custody at a time in which the United States offered bounties for the capture of suspected terrorists.\u201d The majority of the detainees were never even charged with a crime, let alone convicted of one. In total, the U.S. has only convicted six of the 780 prisoners who have been through Guant\u00e1namo\u2019s gates.<\/p>\n<h2><\/h2>\n<h2>2. Trump\u2019s temple of torture<\/h2>\n<p>Leaked documents from the International Committee of the Red Cross (ICRC) in 2004 detail \u201can intentional system of cruel, unusual and degrading treatment and a form of torture at Guant\u00e1namo.\u201d<\/p>\n<p>The ICRC documented the use of humiliating acts, solitary confinement, temperature extremes, use of forced positions, exposure to loud and persistent noise and music, and regular beatings. The UN\u2019s Special Rapporteur for Torture has made it clear that indefinite detention in itself amounts to torture.<\/p>\n<p>The main conclusion of the US Senate\u2019s 2014 probe into CIA torture was that it \u201cwas not an effective means of acquiring intelligence.\u201d But Donald Trump has said he would like to \u201cbring back waterboarding\u201d and \u201ca hell of a lot worse\u201d, adding: \u201cDon\u2019t tell me it doesn\u2019t work &#8211; torture works\u2026 if it doesn\u2019t work, they deserve it anyway.\u201d<\/p>\n<h3><\/h3>\n<h2>3. The expensive mistake<\/h2>\n<p>It costs the US tax payer $445 million a year to keep the remaining 40 detainees held in Guant\u00e1namo. This means that it costs $29,000 per prisoner per night to keep Guant\u00e1namo open \u2013 far more than any federal or state prison.<\/p>\n<h2><\/h2>\n<h2>4. The legal black hole<\/h2>\n<p>In opening Guant\u00e1namo Bay in 2002, the US Government sought to create a legal black hole \u2013 where it argued neither US nor international law applied. Choosing an offshore facility in Cuba as the base, the administration claimed that detainees were not covered by the US Constitution because they were not on US soil, and that their enemy combatant status meant they could be denied legal protections. The \u2018legal protections\u2019 in question ranged from being denied access to lawyers and fair trials to the systematic use of torture.<\/p>\n<h2><\/h2>\n<h2>5. The prison of no exits<\/h2>\n<p>Last year, Donald Trump proudly announced that nobody else would be released from Guant\u00e1namo. There are 40 men still in the prison &#8211; five of those have already been cleared for release in a rigorous process involving six separate US agencies including the Department of Defense and the Director of National Intelligence.
